Suggestions & Guidelines for Owners & Renters
Remember that people are living beside, below, on top, and
across from you. Try to minimize noise (such as "heavy
feet", yelling, rough housing, TV/stereo) and please don't smoke or grill on the ocean side of the units
where the prevailing wind blows the smoke into neighbor's units (a good
alternative is a "George Foreman grill" which you can use inside
and does a very good job).
Please be friendly and say hello to
others. If you see anything that might be wrong or suspicious, please
contact Carol at 695-1605 x. 2, a Director, the on-site office at 481-0976,
or the appropriate authorities.
Please don't park in anyone else's parking spaces - you will
get towed and fined (Rules & Regulations Sections 8A &
8B).
Please don't step on any plants or pick any flowers.
To maintain the appearance and value of our property, please
keep everything that can be viewed by the public looking good (including
drapes, blinds, and things that can be seen through the windows).
Please be friendly and say hello to others. If you see
anything that might be wrong or suspicious, please contact an on-site
Director (see the Safety section) or the appropriate authorities.
Suggestions for owners for preventing or minimizing damage
to your unit and other units:
1)
Give an extra key to us (which we keep in a lock box and only use in case
of an emergency such as a fire or flood). Or, give a key one or two people that live here that you
trust, and
advise us who has your key in case of fire or
flood (or leave a message on the answering machine in the on-site office at
481-0976).
Otherwise, your door may be broken to gain entrance in case of emergency (CC&R Section
4.4, Rules & Regulations Section 7).
2) Prevent flooding! Don't put anything down your sink that might back up the connecting lines to other units - especially potato peels - and advise any workers in your unit (tell them to be sure not to put anything down the drains, and for them not to throw stuff in the sinks and bathtubs - these are the two most common causes of clogs & flooding - which happen much too often). Also, replace your water heater every 7 years. You will be liable for any damages to other units or to Common Area caused by any actions in your unit.
Guidelines/"rules" are used in community associations to maintain the value of the property and the enjoyment of the residents. The following are selected subjects in the CC&R's and Rules & Regulations (please note that the actual CC&R's, and the Rules & Regulations adopted by the Board of Directors of the Association, supercede any statements on this page - please click here to go to the page to view, print, or download these documents):
Occupancy
- Number of people per unit shall conform to City and County health and fire
code regulations.
Pets (CC&R Section 3.4, R&R Sections 3E & 9) - Two are allowed for owners
(for renters, pets are discouraged to avoid increases in common area maintenance
costs). Cats and dogs are not allowed to be off a leash and they are not
allowed to go to the bathroom on the grounds (you can take them out on the
grass on either side of the street - but please pick up after them per city
ordinances).
Annoyance (CC&R Section 3.5, R&R Sections 4B &4C) - Try not to do anything that might
annoy your neighbors. No skateboards or skates. No excessive
noise-making, running, horseplay, loud stereos, loud parties, etc.
Balconies and Patios (CC&R Section 3.7) - Only
items that meet the Patio Furniture
Guidelines (click here) are allowed (basically a simple table and up to
6 chairs, some plants, and, if desired, a barbeque or umbrella (but nothing
can block the view of other owners or inhibit the common area pathway or
maintenance). Covers for patio furniture are
not allowed, except for custom covers for grills. Also, it is not allowed to
enclose balconies or patios in any way, or to put up any type of sun shades or wind
barriers.
Common Area, Equipment, Garbage (CC&R Section 3.9, R&R Section 4E) - No article of any kind shall be draped or placed over railings, fences, balconies, or entrance ways. No shaking of mops, rugs, tablecloths, etc. from balconies is permitted. Throwing of objects, cigars, cigarettes, etc. or sweeping of dirt or water from balconies is not permitted. Mylar type foil or aluminum foil in windows is not permitted.
Swimming Pool, Spa, & Saunas (R&R Sections 12 & 13)
- Hours 7AM-10PM. Residents must accompany all visitors and guests at all
times. No glass containers, pets, cut-offs, nudity, running, obnoxious
behavior, or loud noise. Please consider your neighbors and please
keep the area clean.
Signage (CC&R Section 3.6, R&R Section 4F) - None allowed,
including any inside that can be seen from the outside, except reasonable signage
for sale or rent.
Antennas, Poles, and Wires (CC&R Section 3.8, R&R
Section 4D) - None allowed on buildings or balcony areas (including satellite dishes).
No power equipment, hobby shops, carpenter shops, automobile
overhaul or maintenance (CC&R Section 3.10).
Children are not allowed to play in the parking areas of the
garage (R&R Section 8E).
Common Area Usage or Alteration (CC&R Sections 3.11, 3.12, 3.13, 4.2,
4.3; R&R Section 4A) - Includes that "No Owner shall make any alteration or improvement to
the Common area, or remove any planting, structure, furnishing, or other object
therefrom except with the written consent of the Board of Directors of the
Association.
Right To Enter A Unit (CC&R Section 4.4, R&R Section 7) - The Board of Directors of
the Association or any person authorized by the Board shall have the right to
enter any portion or part of a Unit to carry out common area maintenance, but
shall minimize interference of the occupant and shall be preceded by reasonable
notice wherever circumstances permit. In the case of an emergency (threat
of flood, fire, or life), the right of entry shall be immediate.
Owners must maintain their unit, including keeping it "in a
neat and tidy condition" and maintaining the glass doors & windows,
plumbing, electrical, paint, tile, etc. (CC&R Section 5.1).
Owners "are obligated to promptly, fully, and faithfully
comply with and conform to the By-Laws of the
Association, and the rules and regulations from time to time prescribed
thereunder by the Board of Directors of the Association or its officers, and to
promptly pay in full all assessments levied by the Association on its
members,..." (CC&R Section 4.1).
Owners are responsible for any violations or property damage by
renters (R&R Sections 3A & 5).
Enforcement of Rules and Regulations (R&R Section 14): Each Homeowner and Lessee will be sent a letter upon report of violation. Fines will be levied at the discretion of the Board of Directors. Persistent violation will be subject to legal action.
