Complaints
It is very important in a shared community to have respect for others and to follow some rules, especially for safety and noise disturbance. Many people are reluctant "to complain about their neighbors", but it is important that everyone help maintain a livable community. Also, note that we keep your name confidential, except in the rare case that legal actions require disclosure.
We will most often provide a warning to the owner, but if it is significant, recurring, or there are other complainers or witnesses, we will apply fines.
Problems & complaints about violations of rules:
If you feel comfortable doing so, please advise the person nicely that they are violating a rule. Notifying the person is especially important regarding noise and contractor hours, because additional fines of $100 per half hour are applicable only after the person has been notified to stop. If you are not comfortable doing this, perhaps get another owner or a Board member to go with you. If it is a wild party, it is best to call the Sheriff, at (760) 966-3500, who is very good about coming out and stopping noisy parties.
In general, please report a violation in writing by sending a note or e-mail, by using the Complaint Form in the laundry room, or click here for the complaint form. Please include information regarding the violator (name, description, or unit number), the violation, the day & time, the duration, and any witnesses. You can e-mail or fax the information to Krista at Property Management Consultants (PMC), or place the note or form in the mail slot of the on-site office.
All owners and residents should help enforce the rules, especially regarding safety (spa, pool, skateboards, climbing on the bluff railings or posts, etc.). If you see a safety problem, please advise the person immediately (if you are comfortable doing this), or immediately notify an on-site director or PMC.
Noise disturbance (no loud noise after 10 pm and the contractors hours) is the most enforced rule at Del Mar Shores to keep maintain some peaceful living and sleeping. Contractor hours are strictly enforced because there are always 2-3 units being remodeled, so we would have constant construction noise if the hours were not enforced.
If any of us (or the police) notify any occupant to quiet down after 10 pm (or a
contractor to not work after hours or on weekends), and it continues, we will apply
the fine of $100 plus $100 for every 30 minutes (and fines really do seem to
work in getting owners to "reign in" either their rental companies , their
renters, or their contractors).
Fines
for violations of safety rules will be levied immediately, including:
- Propping
the pool and spa gates open - which can endanger children, violates the law and
can result in fines from the City inspectors whose inspections are unannounced
- Skateboarding - Nothing against skateboarders, but it is dangerous
on the property (and noisy), especially in the garages because drivers
cannot always see well in the garages after coming from bright sunlight, and
older people can be knocked off the sidewalks.
- Not accompanying children in the spa and pool areas (and you must be in
the same enclosure as the children).
Note that we cannot
renters or rental management companies - only the owners - but we do report problems to
both.
Regarding renters, the City regulation on rentals revised in
2004 included requiring the posting that a unit is a rental, with the company
and phone number listed, and it provides that complaints can be made to the City
regarding problems with rentals: the regulations and complaint form

In general, I have found as many problems over the years, or more, with the children and grand-children of owners as compared to renters.
With respect to dogs, we love dogs, but please note the
following:
- It is against the rules to not have a dog on a leash. Dogs
must be kept under controll, and many people are scared of dogs.
- It is against the rules to allow dogs to relieve themselves on the
property. This destroys grass and other landscaping, and it creates
smells.
- It is against the rules and the law to have dogs in the spa and pool
areas.
- If you leave your unit, please put the dog in an area of the unit that
minimizes people hearing their barking. Excessive barking can result in
noise disturbance fines (such as $100 plus $100 every 30 minutes).
